Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 1st and 2nd respondents to permit the petitioner to participate in the Under Graduate Medical Counselling for admission to MBBS/BDS degree courses in Tamil Nadu Government Medical/Dental Colleges for the year 2025-2026 under Special category of Person with Bench Mark Disability (Schedule caste category) Quota and further direct the 3rd respondent to return the petitioner's original certificates without any delay.

The instant writ petition has been filed with a prayer for issuing a Mandamus, directing the 1st and 2nd respondents to permit the petitioner to 2/7
participate in the Under Graduate Medical Counselling for admission to MBBS/BDS degree courses in Tamil Nadu Government Medical/Dental Colleges for the year 2025-2026 under Special category of Person with Bench Mark Disability (Schedule caste category) Quota and further direct the 3rd respondent to return the petitioner's original certificates without any delay.
2. Heard the learned counsel for both sides and perused the materials available on record.

The learned Senior Counsel appearing for the petitioner would submit that the petitioner was initially admitted in the Medical College as per the mark obtained in NEET (UG) Test-2020 and was given allotment in order dated 21.11.2020 for MBBS course before the Tirunelveli Medical College. It is the submission of the petitioner that since she is not in a position to complete her first year Anatomy subject within the permissible four attempts, vide order dated 13.08.2024, she was discharged from her course from the Academic Year 2020-2021. The learned Senior Counsel would further submit that after that the petitioner again participated in 3/7
NEET-2025 examination and has secured 115 marks. It is the further submission of the petitioner that her name was found a place for State Counselling in the Notification dated 21.07.2025 in Serial No.121 under PwBD Quota. It is the further submission of the petitioner that she was having 40% disability, which was also confirmed by the Expert Body constituted as per the NMC Guidelines. However, when she approached the 2nd respondent, they did not permit her to participate in the counselling on the ground that she has not produced her Original Certificates. The learned Senior Counsel for the petitioner would further submit that inspite of her best efforts to get back the Certificates since 14.07.2025, the 3rd respondent did not return the Certificates. Hence, he would pray to permit the petitioner to participate in the counselling under PwBD Quota for the Academic Year 2025-2026.

Initially, the learned Special Counsel appearing for the second respondent raised an apprehension regarding a fresh attempt for NEET UG, after the candidate was discharged for not completing the subject within four attempts. In this regard, the learned Senior Central Government Counsel, on written instructions from the UGMEB, NMC, had submitted that there is no 4/7
bar for taking a fresh admission in accordance with the current NEET UG 2025 scores.

At this juncture, the learned Special Counsel appearing for the 2nd respondent would fairly submit that the petitioner will be allotted a seat under the Government Quota in the round-2 counselling under PwBD Quota. The learned Special Counsel would also submit that they will arrange to get the original educational certificates from the 3rd respondent-Medical College, for the admission of the petitioner.
6. The learned Senior Counsel appearing for the petitioner agreed to the above submissions of the learned Special Counsel. Hence, recording the submissions of the learned Special Counsel appearing for the 2nd respondent, the present Writ Petition is disposed of. No costs.
