Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents herein to conduct survey the land in Survey No.73/5D of Nallatipalayam Village, Kinathukadavu Taluk, Coimbatore District within frame as this Court may fix and pass such further or other orders as deemed fit and proper in the circumstances of the case.

O R D E R

The petitioner herein seeks a direction to the respondents to conduct survey of his property in Survey No.73/5D situated at Nallatipalayam Village, Kinathukadavu Taluk, Coimbatore District.

2. According to the petitioner, she and her sister Mutulakshmi are entitled to 63 ares of land in survey No.73/5D by way of partition deed executed by her father in the name of the petitioner and her sister Muthulakshmi. The petitioner has submitted an on-line application on 10.06.2024 seeking to survey the land and the same has not been considered till date. Therefore, the petitioner is before this Court.

3. Mr.Selvendran, learned Special Government Pleader, who takes notice for the respondents would submit that on-line application of the petitioner for survey of land will be considered on its own merits and appropriate orders will be passed.

In view of the above submission made by the learned Special Government Pleader, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the first respondent to consider the on-line application of the petitioner dated 10.06.2024 and pass final orders, after issuing notice to all interested parties, within a period of six weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition is disposed of. No costs.
