Heard both sides.

2. Learned counsel for the petitioner/respondent brought to the notice of this Court that though three weeks time was granted to the respondent/appellant to rectify the defects as early as on 10.02.2023, the respondent has not rectified the defects till date. Taking advantage of the interim order of stay of passing final decree, they are protracting the final decree proceedings.

3. Considering the above submission made by the learned counsel for the petitioner/respondent and taking into account that the matter has been prolonged from the year 2017, we are inclined to vacate the interim order of stay granted on 28.06.2017. Therefore, the interim order of stay granted by this Court on 28.06.2017 is hereby vacated.

Accordingly, this petition is ordered and C.M.P.No.9873 of 2017 is dismissed.

Post the Appeal for hearing on 26.11.2024.
