ORDER

The impugned order has been passed declining to refer the dispute raised by the petitioner to the jurisdictional Labour Court.

2.A perusal of the impugned order would show that absolutely no reason has been assigned on receipt of the failure report from the Conciliation Officer. The role of the first respondent is rather limited. It cannot go into the merits of the case as sought to be canvassed by the learned counsel for the sixth respondent. The question as to whether the members of the petitioner are working under the sixth respondent or respondents 4 and 5 is a matter to be decided by the Labour Court. 3.In such view of the matter, the impugned order is set aside. Consequently, a direction is issued to the first respondent to refer the dispute to the jurisdictional Labour Court within a period of eight weeks from the date of receipt of a copy of this order. Accordingly, the writ petition stands allowed. No costs. Consequently, connected miscellaneous petition is closed.
