ORDER

The petitioner who was arrested and remanded to judicial custody on 17.05.2023 for the alleged offences punishable under Sections 8(c), 22(c), 29(1) of NDPS Act, 1985 in CC.No.96 of 2023 on the file of the Additional District Judge, Special Court for Essential Commodities Act, Coimbatore in connection with Crime No.330 of 2023 on the file of the respondent police seeks bail.

2. The case of the prosecution is that the petitioner along with other persons were found in illegal possession of 60 grams of Methamphetamine. Hence, this case.

3. Earlier bail petition of the petitioner was dismissed by this Court vide order dated 28.03.2025 in crl.OP.No.5502 of 2025 for the following reasons:

5. Considering the aforesaid facts and the gravity of the offence, this Court is not inclined to entertain the bail petition at this stage. However, the petitioner cannot be incarcerated continuously for an indefinite period without conclusion of the trial.Hence, the learned Additional District Judge/Presiding Officer, Special Court for Essential Commodities Act Cases, Coimbatore District is directed to conclude the trial in CC.No.96 of 2023 as expeditiously as possible. If the trial is not concluded within a period of four

(4) months, the petitioner is at liberty to renew the above petition.

4. The learned counsel for the petitioner submitted that without progressing the trial and the petitioner in under incarceration. He further submitted that though there was earlier direction to complete the trial within a period of four months, till now, the trial has not concluded. Hence, he seeks grant of bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that almost all the witnesses in this case were examined and trial is posted for examination of Investigation Officer and hence, he vehemently opposed the grant of bail to the petitioner.

6. Considering the fact that the trial is reached the stage of examination of Investigating Officer, I am not inclined to grant bail to the petitioner at this stage.
