The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 174 Cr.P.C., subsequently, altered to Sections 302 & 201 IPC, in Crime No.157 of 2023, on the file of the respondent police seeks anticipatory bail. 2.The learned counsel for the petitioner stated that petitioner is an innocent person and he has been falsely implicated in the case registered in Crime No.157 of 2023, for the offences punishable under Section 174 Cr.P.C., subsequently altered to Sections 302 & 201 IPC. Thus, he seeks anticipatory bail to the petitioner.
3. It is stated by the learned Government Advocate (Crl.Side) that the petitioner is the second accused. First and third accused are the sons of the petitioner herein. The victim/deceased was working in third accused's jewellery shop and it is alleged that he had committed misappropriation of gold jewellery from third accused's jewellery shop. Enraged at this, third accused with the help of his brother and father, 1/3
namely, first and second accused, abducted the deceased to their agricultural land and thereafter, committed the act of murder and had thrown the body in a Well. This attracts Sections 302 and 201 IPC. Thus, he prayed for dismissal of this petition. 4.The learned counsel for the petitioner stated that the first and third accused had been granted bail. It is seen that the first accused was granted bail since charge sheet was not filed. That would have no effect on the petitioner seeking anticipatory bail. It would be advisable if the petitioner surrenders.
