The suit has been filed under Section 105 of The Patents Act, 1970 seeking for a declaration as to the non infringement by the plaintiff.

2. The defendant has made a claim that the plaintiff has infringed its Patent. The plaintiff is having its Registered Office as well as the Principal Office at Chennai. According to the plaintiff all the internet servers pertaining to the alleged infringement claim made by the defendant are all located at Chennai. Hence, according to the plaintiff, major part of cause of action has arisen within the jurisdiction of this Court. In such circumstances, this application has been filed seeking for leave to sue the defendant.

3. Since the major part of cause of action has arisen within the jurisdiction of this Court, this Court is inclined to grant Leave to Sue as prayed for in A. No 5144 of 2023.
