ORDER
The petitioner seeks for implementation of the order dated 16.08.2024 passed by this Court in W.P. No.23450 of 2024 by obtaining patta in his name for the property morefully described in the prayer to this writ petition, which has been rejected under the impugned order dated 28.04.2025 passed by the fourth respondent on the ground that the fourth respondent is not a competent authority.
2. The operative portion of the order dated 16.08.2024 passed by this Court in W.P. No.23450 of 2024 in the writ petition filed by the very same petitioner reads as follows:
"3. It is not in dispute that the third respondent/Revenue Divisional Officer, passed an order as early as on 07.03.2019 deleting the wrong entry in the revenue records and restoration of the patta in the name of the petitioner' vendor Lakshamma, wife of Maniyappa. Therefore, the fourth respondent is duty bound to implement the same and hence, a direction is issued to the fourth respondent to implement the order of the third
respondent dated 07.03.2019 within a period of four weeks from the date of receipt of copy of this order."
3. Even, in this writ petition, the petitioner seeks for implementation of the order dated 07.03.2019 passed by the Revenue Divisional Officer viz., the third respondent.
4. As seen from the directions issued by this Court on 16.08.2024 in W.P. No.23450 of 2024, which has been extracted supra, it is made clear that the fourth respondent is duty bound to implement the order dated 07.03.2019 passed by the Revenue Divisional Officer viz., the third respondent and therefore, the petitioner is entitled for patta in his name in view of the fact that in the order dated 07.03.2019 passed by the Revenue Divisional Officer viz., third respondent. The wrong entry in the Revenue records pertaining to the property morefully described in the prayer to this writ petition was directed to be corrected and the property was restored to its original classification viz., " Patta Land".
5. The petitioner has not chosen to file a contempt petition as against the disobedience of the order dated 16.08.2024 passed by this Court in W.P. No.23450 of 2024 till date.
6. The learned counsel for the petitioner seeks liberty for the petitioner to file a contempt petition for the disobedience of the order dated 16.08.2024 passed by this Court in W.P. No.23450 of 2024 filed by the very same petitioner.
7. In view of the statement made by the learned counsel for the petitioner, this writ petition is disposed of by granting liberty for the petitioner to file a contempt petition for the disobedience of the order dated 16.08.2024 passed by this Court in W.P.
