KRISHNAN RAMASAMY, J., This Court vide order dated 14.12.2022, appointed an Advocate Commissioner to seize KOBELCO EXCAVATOR SK140LC-8 vehicle. As per the order of this Court, he has initiated steps to seize the vehicle. However, it appears from the report of the Advocate Commissioner at paragraph No.6 that the respondent surrendered the vehicle to the Inspector of Police, E6 Palacode Police Station on 19.01.2023 and the vehicle was kept in the premises of Police Quarters at Palacode near E6 Police Station. The Advocate Commissioner further submitted that he has given a written representation to the police station to seize the vehicle that was handed over by the respondent on 19.01.2023 but the same was refused.

2. Under these circumstances, this Court directs the Inspector of Police, E6 Palacode Police Station to hand over the vehicle to the applicant and the Advocate Commissioner is permitted to seize the vehicle from the applicant as per the direction of this Court. Page No.1/3

3. In the meantime, this Court direct the Inspector of Police, E6 Palacode Police Station, to appear before this Court and explain the reason for retaining the vehicle in the police station, when this Court specifically directed the Advocate Commissioner to seize the vehicle. He shall appear on 09.02.2023.

4. The petitioner as well as the Advocate Commissioner is directed to send a copy of this order to the concerned police station and upon receipt of the same, he is directed to appear before this Court.

5. Post this case on 09.02.2023.
