ORDER

This matter is taken up for hearing under the caption "For Being Mentioned" today at the instance of the learned counsel for petitioner.

2. The learned counsel appearing for petitioner submitted that earlier, this Court passed an order dated 07.10.2025 and suspended the sentence imposed on the petitioner by the learned Principal Sessions Judge, Puduchery in CRl.A.No.61 of 2023. In the said order. this Court has permitted the defacto complainant to withdraw the amount which is the default clause. However, in this case permitting the defacto complainant in withdrawing the amount, will result in certain consequences and he will not co-operate in contesting the case. Hence, prays to remove the same.

3. Considering the submissions made by the learned counsel for the petitioner, the Registry is directed to remove clause (e) in the paragraph no.4 and issue fresh order to the parties concerned.

4. All other observations made in the order dated 07.10.2025 remains intact.
