Murugan v. Inspector Of Police

2023-11-27Honourable Mr Justice C.V. Karthikeyan2 pages

Crl.O.P.No.23026 of 2023 Crl.O.P.No.23026 of 2023 C.V.KARTHIKEYAN, J.

A1 & A2 in Crime No.32 of 2022 registered under Sections 419, 423, 467, 468 & 471 IPC seeks anticipatory bail. 2.It is stated that a complaint was lodged by one Santha stating that her husband died 25 years ago and that she is the sole legal heir of her father, one Subbarayan. Her father owned a land situated at Mayilam Village, Survey No.266/3, New Survey No.38/15, measuring 1.42 cents. Out of the said land, her father had executed a gift settlement deed for 0.48 cents by a registered document. Taking advantage of the death of her father, it is stated that A1 had set up A3 as impersonator and A3 had sold that land to A2 and A2 had in turn sold the land to A5. It is thus seen that both the petitioners herein, on the one hand sold land, created a dead person as alive and purchased land as if the dead person had executed a sale deed through A3.
