..Respondent(s) PRAYER: This writ petition is filed under Article 226 of the Constitution of India praying to issue a writ of Mandamus directing the 2nd respondent to consider the petitioners application dated 24.03.2024 to conduct enquiry for correction the entries in the books maintained by the 3rd respondent within a time frame as fixed by this Court.

ORDER

The petitioners state that they filed O.S.No.97 of 2025 on the file of the District Munsif Court, Omalur, challenging the sale deed dated 10.01.2025, which was executed in favour of the fourth respondent. In the said suit, it is stated that an interim application was filed to restrain the defendants therein from alienating the property. It is also stated that the jurisdictional Sub Registrar is a party to the suit. Pending suit, it is stated that the property was alienated in favour of the seventh respondent by the sixth respondent. After submitting a representation dated 24.03.2025 to conduct an inquiry and correct the entries pertaining to the sale deed executed while the suit was pending, the present writ petition is filed.

2. Learned Special Government Pleader appears on behalf of respondents 1 to 3. He submits that the registering officer does not have the power to cancel the registered documents or efface entries relating thereto from the register of encumbrances, unless directed by a court.

3. The petitioners have instituted a civil suit and have also filed an interim application therein to restrain alienation of the suit property. The alienation complained of in this writ petition appears to be an alienation lis pendens. Given

that the registering officer does not have the power to cancel the registered documents, no useful purpose would be served by directing an inquiry. It is always open to the petitioners to seek and obtain both interim and final reliefs in the pending civil suit. With these observations, the writ petition is disposed of without any order as to costs. Consequently, connected miscellaneous petitions are closed.
