This Original Petition has been filed seeking grant of Letters of Administration under Sections 232 & 276 of Indian Succession Act, 1925 with Will annexed, relating to the last will dated 02.11.2016 executed by Mr.N.S.Natarajan who died on 10.10.2018. He died as a bachelor. He had a brother and the petitioner is the daughter of the brother. He also had a sister and the respondent is the son of the sister. The petitioner and the respondent are the only Class-II legal heirs. The respondent has also filed his consent affidavit.

2. Mrs.R.Revathi, the petitioner was examined as Ex.P.W.1. The original will dated 02.11.2016 was marked as Ex.P1 and the death certificate of Mr.N.S.Natarajan was marked as Ex.P2. The affidavits of assets was marked as Ex.P6.

3. The evidence of Mr.S.P.Sive Pradosh was examined as Ex.P.W.2. He was one of the attesting witnesses and he identified the will and he also stated that one Mr.S.Angayasamy was also one of the attesting witnesses. He affirmed the signatures and further stated that Mr.N.S.Natarajan was in a sound and disposing state of mind at the time of execution of Will.

nst grant the relief sought in the Original Petition namely, granting Letters of Administration with Will annexed.

5.With the above observations, this Original Petition stands allowed. The petitioner is directed to duly administer the properties and credits of the deceased more fully described in the schedule. The petitioner is directed to execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) in favour of the Assistant Registrar (O.S.II) High Court, Madras. The petitioner is further directed to render true and correct accounts once in a year.
