ORDER

The petitioner seeks to quash the Charge Sheet in Spl.S.C.238 of 2023 on the file of Special court for Exclusive Trial of cases under POCSO Act at Chennai.

2. The petitioner is the brother of the second respondent/defacto complainant. The defacto complainant's elder daughter, who is a minor, was in love affair with the petitioner. During their relationship, she became pregnant. At the time of delivery, only at the insistence of hospital authorities, FIR was registered. Now, the minor girl and the petitioner appeared before this Court and sought to compromise the matter amicably.

3. Taking note of the fact that the defacto complainant has been examined before the Trial Court, this Court is not inclined to quash the proceedings at this stage. It is open to the petitioner to file necessary application to recall PW1 and

examine before the Trial Court. The Trial Court shall take into consideration of her evidence and relationship, dispose of the case expeditiously.
