ORDER
(Order of the Court was made by The Hon'ble Chief Justice) The petitioner has not been represented on the last three occasions.
2. The matter was taken up on January 25, 2021. Though the functioning of the court was primarily on the virtual mode at that point of time, physical attendance was not altogether prohibited and, in the event any person faced any difficulty in
participating in proceedings on the virtual mode, physical representation was allowed.
3. The matter next appeared on March 10, 2021 when it had not dawned on us that the second surge of the pandemic had already begun. Indeed, measures taken to deal with the second surge, including restricted functioning of court, government imposed lockdown and the like, came much later. Yet the petitioner was not represented on March 10, 2021. The matter appeared on March 31, 2021 when the petitioner was, again, not represented.
4. It is possible that the petitioner may have lost interest in the matter or does not seek to pursue it.
5. W.P.No.29716 of 2019 is dismissed for default.
6. Though in the present restricted form of functioning, exparte orders and orders of dismissal for default are generally not passed, the consistent conduct of this petitioner permits an order of dismissal to be made. In any event, if the petitioner is interested in pursuing the matter, an application for recalling would suffice.
