Kavitha v. Amusu
C.M.P.Nos.24538 & 24536 of 2023 in A.S.Nos.482 & 483 of 2019 S.VAIDYANATHAN,J.
AND K.RAJASEKAR,J.
Contesting respondents have not objection for the appeals being restored and taken up on merit.
However, the counsel for Respondents 8 and 9 submits that no prejudice is going to be caused to the present petitioner in withdrawing the appeals.
Since the suits pertain to partition, it is appropriate to allow the parties to address the arguments.
Mr.T.M.Hariharan, counsel for the petitioner, would submit that no notice has been served on him.
Without expressing any view on merit, we recall the order, dated 21.06.2023, passed in A.S.Nos.482 and 483 of 2019, and direct the Registry to post the matters before the portfolio Court.
Civil Miscellaneous Petitions are allowed.
