The petitioner, who was arrested and remanded to judicial custody on 16.09.2023 for the offences punishable under Sections 147, 148, 294(b), 323, 364A, 386, 506(2) IPC, in Crime No.279 of 2023, on the file of the respondent police, seeks bail.

2.The learned counsel for the petitioner drew my attention to the FIR, wherein, in the complaint, the defacto complainant has stated that he is doing a business by running "King Gym" and also has cottage at Yercaud. The learned counsel further pointed out the averments in Crime No.280 of 2023, wherein it is stated that defact complainant has been charged under Sections 5 r/w 7(3) of Lotteries Regulations Act, 1988 and Section 420 IPC on 17.09.2023. 3.However, perusal of the records also shows that petitioner has yet another case in Crime No.386 of 2021, under Sections 120(b), 147, 148, 302, 341 @ 302, 147, 148, 341, 120(b) IPC registered with the respondent police. 4.The learned Government Advocate (Crl.Side) stated that investigation is still pending. Moreover, on the side of the respondent, it is stated that A3, A4 and A5 are still absconding. The petitioner along with the 1/3

other accused, kidnapped the defacto complainant in a Car and demanded a sum of Rs.10,00,000/- (Rupees Ten Lakhs only) and received a sum of Rs.30,000/- (Rupees Thirty Thousand only).Thus, he prayed for dismissal of this petition.

5.Taking into consideration the particular fact that A3, A4 and A5 are still absconding and there is one previous case as against the petitioner, at this stage, I am not inclined to grant bail to the petitioner. If there is any change of circumstances, petitioner is at liberty to file a fresh petition. 6.Accordingly, this Criminal Original Petition stands dismissed. 09.10.2023 mkn2/sli 2/3
