Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the second respondent to take appropriate action on the proposals submitted by the third respondent in Na.Ka.No.Aa/364/2003 dated 20.11.2014 for passing appropriate orders on the petitioner's request for compassionate appointment in any suitable post. ORDER

This writ petition has been filed by Mrs.J.Vijaya seeking a writ of mandamus, directing the second respondent-District Adi Dravidar Welfare Officer, Villupuram to take appropriate action on the proposal submitted by the third respondent in Na.Ka.No.Aa/364/2003 dated 20.11.2014 in regard to the request of the petitioner for compassionate appointment in any suitable post.

2. The petitioner's husband Mr.T.Jeganathan, who was working as Secondary Grade Teacher at the Government Adi Dravidar Welfare School, Poo- Mambakkam, died on 19.2.2003 while in service leaving behind the petitioner and her daughter Jeevitha in indigent circumstances. As she became a widow at the age of 22 years, she was not able to look after her minor daughter without https://hcservices.ecourts.gov.in/hcservices/

employment. Therefore, she submitted an application to the Special Tahsildar, Adi Dravidar Welfare, Ulundurpet requesting for compassionate appointment by enclosing all the requisite documents such as death certificate, legal heir certificate, no objection letter, etc. But till date, no order has been passed. However, after repeated representations, the third respondent has submitted a proposal dated 20.11.2014. In spite of the proposal, the second respondent has not come forward to appoint the petitioner on compassionate ground in any suitable post. Therefore, she has come to this Court.

3. Mr.S.Gunasekaran, learned Additional Government Pleader takes notice on behalf of the respondents.

4. Considering the limited relief sought for by the petitioner, without going into the merits, the writ petition is disposed of with a direction to the second respondent to consider the application of the petitioner for compassionate appointment, if she is having the requisite qualification, in the light of the proposal sent by the third respondent dated 20.11.2014, on merits and pass appropriate orders in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. No costs.
