Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondents 1 & 2 to sanction one set of incentive increment to the petitioner for having acquired higher qualification namely M.Sc., in Mathematics during the year 2012 by considering the proposal sent by the third respondent on 20.03.2015 as well as the representation dated 10.10.2015 of the petitioner with all consequential benefits.

ORDER

The petitioner, after acquiring B.Sc.,B.Ed., qualification, was appointed as B.T.Assistant(Maths) in the third respondent School on 10.4.2008 and her services were also regularized in the said post. Subsequently, she acquired the qualification of M.Sc.(Mathematics) from Annamalai University during the year 2012. Therefore, she submitted representations dated 24.7.2013 and 25.8.2014 to the respondents 1 and 2 through the third respondent to sanction one set of incentive increment for https://hcservices.ecourts.gov.in/hcservices/

acquiring the higher qualification. Thereafter, the third respondent also sent a proposal dated 20.3.2015 to the respondents 1 & 2 recommending for the sanction of incentive increment. Finding no response, the petitioner made another representation on 10.10.2015. Since the said representation has also not been considered by the respondents 1 and 2, she has come to this Court.

2. Heard the learned counsel for the petitioner. Mr.S.Gunasekaran, learned Additional Government Pleader takes notice on behalf of the respondents.

Considering the limited relief sought for by the petitioner, the writ petition is disposed of with a direction to the respondents 1 and 2 to consider the representation of the petitioner dated 10.10.2015, in the light of the proposal sent by the third respondent dated 20.3.2015, on merits and pass appropriate orders in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. No costs.
