ORDER
This Criminal Original Petition has been filed to transfer the investigation in Cr.No.324 of 2024 on the file of the third respondent to Crime Branch Criminal Investigation Department or any other agency.
2. Heard the learned counsel on either side and perused the materials placed on record.
3. The petitioner got married with the deceased by their own wish. Both belong to different community. However, after their marriage, there was misunderstanding between them and they got separated. While being so, her husband filed a petition seeking divorce in H.M.O.P.No.148 of 2023, on the file of the Sub Court, Arakkonam. When the same was pending, he had committed suicide by hanging himself and died.
4. On the complaint of one Sathish, FIR has been registered by the third respondent in Crime No.324 of 2024 under Section 174 of Cr.P.C. Now, the petitioner, who is being the wife of the deceased filed this petition for
transfer of investigation, on the ground that her husband died in a mysterious circumstances.
5. The learned Government Advocate (Crl.side) appearing for the respondents submitted that the petitioner's husband died by hanging himself. The third respondent is waiting for viscera report and on receipt of the same, the entire investigation will be completed.
6. Therefore, at this stage, if the investigation is transferred to any other investigation agency, it would affect the entire investigation already done by the third respondent and this Court is not inclined to transfer the investigation in Cr.No.324 of 2024 on the file of the third respondent to any other investigation agency. However, the third respondent is directed to complete the investigation and file a final report in Crime No.324 of 2024, within a period of twelve weeks from the date of receipt of a copy of this order.
