C.M.P.Nos. 11701, 11702, 11703 of 2017 & 3193, 3329, 3330 of 2024 in S.A.No. 1476 of 2010 C.KUMARAPPAN, J There is no serious objection on behalf of the respondents in allowing these petitions in C.M.P.Nos. 11701, 11702 and 11703 of 2017. Hence having considered the submission made by the learned counsel for the petitioners and having satisfied with the averments made in the affidavit, these petitions in C.M.P.Nos. 11701, 11702 and 11703 of 2017 are allowed and the petitioners 2 to 5 are directed to implead as appellants 2 to 5 as legal heirs of the deceased sole appellant.

2. Registry is directed to make necessary amendment in the appeal memorandum.

3. The learned counsel for both sides would submits that there is scope for Mediated settlement in this matter and prays to refer this matter to the Tiruppur Mediation Centre. Hence, after making necessary amendment in the appeal memorandum, Registry is directed to forward the copy of the papers to the Mediation Centre attached with District Court, Tiruppur and the parties are directed to appear before the Mediation Centre on 10.05.2024. Both the parties are directed to make an endeavour to resolve the issue within a month before

the end of May, 2024 and post this matter before this Court on 06.06.2024 along with the mediation report.

4. In view of the order passed and also based upon the endorsement made by the learned counsel for the petitioners, petition in C.M.P.Nos. 3193, 3329 and 3330 of 2024 are dismissed as not pressed as prayer already been answered in the C.M.P.Nos. 11701, 11702 and 11703 of 2017. 30.04.2024 nsl
