ORDER
W.M.P.No.34968 of 2025 seeking to permit the petitioners to file a single writ petition, stands ordered on payment of separate Court fee.
2. This writ petition has been filed for issuance of a mandamus to the respondents 1 to 5 to handover vacant possession of the subject lands to the petitioners within the time frame fixed by this Court.
3. Heard both sides.
4. The fourth and fifth respondents conducted the auction on 11.03.2025, in which the petitioners and also the sixth and seventh respondents participated. The petitioners were the successful bidders and had also paid the lease amount to the temple. The grievance of the petitioners is that the respondents 6 to 8 are not allowing the petitioners to enter into the land. It is under these circumstances, the present writ petition came to be filed before this Court.
5. When the matter was taken up for hearing today, the learned Special Government Pleader appearing on behalf of the H.R. & C.E. Department confirmed the fact that the petitioners are the highest bidders in the auction. It was further submitted that necessary steps will be taken to handover possession of the lands to the petitioners.
6. Considering the above submissions, the H.R. & C.E. Department
shall ensure that the possession of the lands are handed over to the petitioners as expeditiously as possible, but not later than four weeks from the date of receipt of a copy of this order. If necessary, it is left open to the Department to seek for police protection. Insofar as the claim made by the petitioners for extension of the lease period, since they have not been put into possession as on date, the same will be considered by the third and fourth respondents.
7. This writ petition is disposed of in the above terms. No costs. Index : yes/no 19.08.2025 ss To
