ORDER

Mr.G.Vasuthevan, learned Standing counsel accepts notice on behalf of the respondents. With the consent of the learned counsels on either side, the writ petition is taken up for final disposal at the admission stage.

2.This Writ Petition is filed for mandamus directing the first respondent to allot the vacant site Tiny Sector No.67A at Guindy ThiruVi-Ka Industrial Estate, Ekkaduthangal, Chennai, to the petitioner based on her representation dated 02.07.2025, and pass further orders. 3.The petitioner states that the respondent allotted a Tiny Shed measuring 400 sq. ft in Guindy Industrial Estate, Ekkaduthangal, Chennai, to the petitioner along with other allottees. While so, in 1991, the respondent developed the vacant land on the rear side of the existing

allotments. The petitioner submitted a representation to the first respondent on 25.09.1992, for allotment of vacant site on the rear side of her plot. As the first respondent failed to consider the petitioner's representation, the petitioner filed W.P.No.10555 of 1998, which was dismissed on 29.09.2000.

4.The petitioner further states that thereafter the petitioner filed another writ petition in W.P.No.4710 of 2011, seeking direction to the respondent to allot the vacant site in S.No.67-A behind T.S.No.67, allotted to her in Guindy Industrial Estate, Ekkaduthangal, Chennai, based on her representation. The said Writ Petition was dismissed on the ground that the site fell under common purpose area. The petitioner thereafter filed a writ appeal in W.A.No.4107 of 2019. The said writ appeal was also dismissed, however, with liberty to the petitioner to seek remedy if, there was any change in future on the nature of the site. Later, the petitioner filed an application under RTI Act, and received information that the plot No.67-A was not OSR Land. Under the circumstances, the petitioner submitted a fresh representation on 02.07.2025 for allotment of the plot No.67A in favour of the petitioner. Since no action was taken by the respondent on the said representation,

the petitioner filed the above Writ Petition for the aforesaid relief. 5.Heard both sides and perused the materials placed on record. 6.The facts are undisputed. Even though the petitioner failed in the earlier rounds of litigation, based on the liberty granted in the writ appeal, the petitioner applied under RTI Act, for information on the nature of the site. The petitioner received information that the site was not OSR land. Hence, the petitioner submitted the fresh representations on 27.02.2025, for allotment of the said plot. However, the respondents did not respond and hence, the present writ petition. 7.Under the aforesaid facts and circumstances of the case, this Court is inclined to direct the 1st respondent to consider the petitioner's representation dated 02.07.

2025, in the light of the information received by the petitioner under the RTI Act, that the land is not OSR land and pass orders on merits and in accordance with law, within a period of four weeks, from the date of receipt of a copy of this order. In the meanwhile the petitioner is permitted to submit an online application for the allotment.

With the above observations and directions, this Writ Petition is disposed of. Consequently, connected Miscellaneous Petition is closed. No costs.
