This petition has been filed to enlarge the petitioner on bail in CC No. 225 of 2022 on the file of the Principal Special Judge under EC and NDPS Act cases, Chennai.

2. The case of the prosecution is that the respondent police seized 99 grams of Methaphetamine from the accused. Hence, the case.

3. The learned counsel for the petitioner submits based the petitioner has been implicated in this case. Further, he submits that for the past three years the petitioner is in custody hence the petitioner may released on bail to that effect he relied the judgment of the Apex Court reported in 2023 SCC Onlie Sc 1109.

4. The learned Government Advocate (Crl. side) submits that due to non-cooperation of the petitioner the trial is not completed and L.W.1 to L.W.3 were not cross examined. Hence, he prayed to dismiss this petition. T.V.THAMILSELVI, J.

5. Considering the facts and circumstances of the case, the petitioner is not cooperate for the trial and the judgement relied by the petitioner is not applicable to the facts of the case. Hence, I am not inclined to allow this petition. Accordingly, this petition is dismissed.
