Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the third respondent herein to 1/5

consider and pass necessary orders in Na.Ka.No.2399/2019/Aa1, dated 09.07.2024 based on the reply dated 17.08.2024 submitted by the petitioner in enquiry before the third respondent herein.

O R D E R

The petitioner herein seeks a direction to the third respondent to complete the enquiry initiated by him in his proceedings in Na.Ka.No.2399/2019/Aa1 dated 09.07.2024 and pass final order, by considering the petitioner's reply dated 17.08.2024.

It is seen from the typed set of papers that the fourth respondent herein filed an application before the third respondent seeking issuance of patta in respect of the land with an extent of 9 acres 15 cents in S.No.1321/1A, at Thaiyur Village, Thiruporur Taluk, Chengalpattu District. The third respondent issued enquiry notice to the petitioner and the fourth 2/5

respondent in his proceedings in Na.Ka.No.2399/2019/Aa1 dated 09.07.2024. In response to the enquiry notice of the third respondent, the petitioner submitted a reply on 17.08.2024 objecting to grant of patta in favour of the fourth respondent and the same has not been considered and enquiry is still pending. Therefore, the petitioner has come before this Court.

3. Mr.P.Sathish, learned Additional Government Pleader, who takes notice for the respondents 1 to 3 would submit that the reply submitted by the petitioner will be considered and on conclusion of enquiry, the third respondent will pass final order, within a time frame fixed by this Court.

In view of the same, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the third respondent to complete the enquiry initiated by him in his proceedings in Na.Ka.No.2399/2019/Aa1 dated 09.07.2024 and pass final order, after considering the objection raised by the petitioner in his reply dated 17.08.2024, on its own merits, within a period of 8 weeks from the date of receipt of copy of this order.

5. With the above directions, this Writ Petition is disposed of. No costs.
