Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of mandamus to direct the first respondent to consider the representation of the petitioner dated 6/1/2016 and to transfer the patta from the second respondent Kathirvel to the petitioner's husband Karunanithi name bearing Survey No.90/5A, measuring about 1526 sq.feet, situated at Anganur Village, Senthurai Taluk, Ariyalur District.

With the consent of the learned counsel appearing on either side, this writ petition is taken up for final disposal, at the admission stage itself.

Heard Mr.M.Velmurugan, learned counsel for the petitioner and Mr.S.Navaneethan, learned Additional Government Pleader for the first respondent.

3. This writ petition has been filed praying to direct the first respondent, to consider the representation of the petitioner, dated 6/1/2016 and to transfer the patta from the name of the second respondent to the petitioner's husband. https://hcservices.ecourts.gov.in/hcservices/

4. The petitioner had purchased a plot bearing Survey No.90/5A, measuring about 1526 sq.feet, situated at Anganur Village, Senthurai Taluk, Ariyalur District from the second respondent.

After the purchase, the petitioner made a representation to the first respondent to transfer the patta in her husband's name. Since the first respondent has not issued any patta, the petitioner has come forward with the present writ petition praying for the relief as stated therein.

Without going into the merits of the claim of the petitioner, the first respondent is hereby directed, to consider the case of the petitioner, for issuance of patta and pass an appropriate order, on merits and in accordance with law, within a period of six weeks, from the date of receipt of a copy of this order, by affording an opportunity of personal hearing, to the petitioner as well to the necessary parties. It is made clear that this Court has not expressed any opinion with regard to the merits of the claim of the petition.

6. With the above direction, this writ petition is disposed of. No costs.
