ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. In view of the order that this Court proposes to pass and also the limited relief that is sought to be granted, notice to the Respondent No.3 and 4 is dispensed with.

The present writ petition is filed praying for a writ of mandamus, to forbear the 2nd respondent from issuing Patta in the name of the 3rd respondent, pending the disposal of O.S.No.37 of 2025 on the file of District Munsif cum Judicial Magistrare, Cheyyur, based on the petitioner's objection letter dated 05.08.2025.

At the outset it is submitted by the learned Additional Government Pleader that they would consider the above objection letter dated 05.08.2025 and conduct an enquiry after issuing notice to the petitioner, 3rd and 4th respondent and thereafter pass appropriate orders within a time frame to be fixed by this 2/4

Court, agreed to by the learned counsel for the petitioner.

4. In view thereof, the writ petition stands disposed of with a direction to the respondents to consider the petitioner's objection letter dated 05.08.2025. While considering petitioner's objection letter, the concerned respondent shall issue notice and afford a reasonable opportunity of hearing to the petitioner, 3rd and 4th respondent and thereafter pass appropriate orders keeping in view Rule 4(4) of Patta Pass Book Rules, 1981, which imposes a restriction/limitation on mutation of patta during the pendency of a suit. The entire exercise shall be completed within a period of 12 weeks from the date of uploading of web copy without waiting for the receipt of certified copy. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law. No costs. Consequently, connected miscellaneous petitioners are closed.
