ORDER

The petitioner, who was arrested and remanded to judicial custody on 30.06.2025, for the offences punishable under Section 20(b)(ii)(A) of NDPS Act and Section 25(1B)(a) and 3 of Arms act, 1959 in Crime No. 386 of 2025, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the petitioner along with co-accused were alleged to have been in illegal possession of 300 grams of narcotic substance along with country gun. Hence, the case.

3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has been falsely implicated in this case. He submits that he has not committed any offence as alleged by the prosecution. He also submits that the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submits that there are totally four accused and all the accused persons hails from the State of Bihar. Hence,he opposed for grant of bail to the petitioner.

5. The petitioner herein was arrested on 30.06.2025 for the offences under Sections 20(b)(ii)(A) of NDPS Act and Section 25(1B)(a) and 3 of Arms act, 1959. According to the prosecution, 300 grams of ganja along with country gun were seized from this petitioner. This petitioner and all the co-accused were belongs to the State of Bihar and ganja and the country gun were pre-seized from them. The learned Government Advocate (Criminal Side) opposed the grant of bail due to the prevailing crime committed by the persons outside the State. The release of this petitioner at this stage may tamper the investigation. Considering the objections made by the learned Government Advocate (Crl.side), this Court is not inclined to grant bail to the petitioner.
