ORDER

The petitioner / Accused, who was arrested and remanded to judicial custody on 27.12.2023 for the offences punishable under Sections 8(c) r/w 20(b)(ii)(C), 25, 29(1) of NDPS Act in Cr. No.63 of 1/5

2023 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused was found in illegal possession of 30 kgs of Ganja. Hence the case.

3. The learned counsel for the petitioner would contend that the petitioner has been falsely implicated in this case, that he was arrested and remanded to judicial custody on 27.12.2023 for the offences punishable under Sections 8(c) r/w 20(b)(ii)(C), 25, 29(1) of NDPS Act and the petitioner is an innocent and he is ready to abide by any condition imposed by this Court. Hence, he prayed that the petitioner may be released on bail.

The learned Government Advocate (Criminal Side) would submit that the petitioner was arrested and remanded to judicial custody on 27.12.2023 for the illegal possession of 30 kgs of Ganja and he has ten previous cases pending against him and hence he strongly opposed to grant bail to the petitioner. Further, the learned Government Advocate 2/5

appearing for the State would submit that the investigation was completed and charge sheet was also filed and the case is now pending for trial.

5. Heard both sides and perused the materials available on record.

6. Considering the rival submissions on either side, considering the grave nature of offences and considering the fact that the contraband recovered from this petitioner is a commercial quantity and investigation was completed and charge sheet was also filed and now the case is pending for trial, I am declined to grant bail to the petitioner at this stage. However, considering the lond pendency of the case, it is appropriate to direct the trial court to complete the trial within a stipulated time.

7. Accordingly, this Criminal Original Petition is dismissed. The trial Court is directed to complete the trial within 4 months from the date of receipt of a copy of this order.
