Respondents Petition filed under Article 226 of The Constitution of India praying for the issuance of a writ of mandamus to direct the respondents to take appropriate action to remove encroachment in Sy.No.164 C and 165B in Rathinamangalam Village, Chengalpattu Taluk, Kancheepuram District, made by the fourth respondent or any other persons within a stipulated time. ORDER
(Order of the Court was made by SATISH K.AGNIHOTRI, J.) Ms.A.Srijayanthi, learned Special Government Pleader accepts notice on behalf of respondents 1 to 3. Notice to the fourth respondent is dispensed with at this stage, as no adverse order is passed against him in this writ petition. Thus, with the consent of the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for respondents 1 to 3, the writ petition is taken up for final disposal.
2.Seeking a direction to respondents 1 to 3 to take appropriate action to remove the encroachment in S. Nos.164 C and 165 B in Rathinamangalam Village, Chengalpattu Taluk, Kancheepuram District, made by the fourth respondent or any other persons, the petitioner has come up with this writ petition.
3.Learned counsel appearing for the petitioner submits that taking note of the representation made by the petitioner on 20 October 2015, the Revenue Divisional Officer, Chengalpet has sent a communication to the Tahsildar on 07 December 2015 to conduct an enquiry and site inspection and take necessary action, if it is found that there is encroachment. According to the learned counsel for the petitioner, no step has been taken thereafter. the issue is pending consideration unattended till date. Thereafter, the petitioner has made one more representation on 22 January 2016.
4.Learned Special Government Pleader appearing for respondents 1 to 3 submits that appropriate action will be taken within a period of six weeks, after issuing proper notice to the encroachers.
5.In view of the above submission made by the learned Special Government Pleader appearing for respondents 1 to 3, it is ordered accordingly.
6.With the aforestated observation and direction, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
