The petitioner/A3, who was arrested and remanded to judicial custody on 18.07.2024, for the offences under Sections 392 and 397 of the Indian Penal Code in Crime No.292 of 2020, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 04.03.2020, the petitioner and the co-accused had broken open the door, trespassed into the de facto complainant's house, robbed a sum of Rs.1,60,000/-, 60 sovereign gold jewels and escaped from the place of occurrence. Hence the complaint.

3. Learned counsel appearing for the petitioner would submit that the petitioner is an innocent person, he has not committed any offences as alleged by the prosecution and he has been falsely implicated in this case. He also submitted that the petitioner is in custody for more than 65 days; that he is a law-abiding citizen; and that he is ready and willing to furnish substantial sureties for his due release on bail and to abide by any 1/4

conditions that may be imposed by this Court. Hence, he prayed for the grant of bail to the petitioner.

Learned Government Advocate (Criminal Side) for the respondent police submitted that the petitioner and the co-accused had broken open the door and trespassed into the de facto complainant's house; that they tied up the de facto complainant and his family members, including the children; that they robbed a sum of Rs.1,60,000/-, 60 sovereign gold jewels and escaped from the place of occurrence. He further submitted that the investigation is at an initial stage. Hence, he vehemently opposed the grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the submissions made by both sides, the gravity of the offence and that the investigation is at an initial stage, this Court is declining to grant bail to the petitioner at this stage. 2/4
