The Criminal Original Petition has been filed seeking to quash the First Information Report in Crime No.428 of 2024, registered on the file of the first respondent Police, for the offence under Sections 281 and 106(1) of BNS.

Heard both sides and perused the materials available on record. 3.

The crux of the allegation in the First Information Report is that the petitioner, who is the correspondent of the Amethyst International School, has been arrayed as an accused in this case for the reason that, due to the speed breaker put by him in front of his school, the de facto complainant's father, while riding a motor cycle, fell down and died. 4.

However, the very allegation in the First Information Report itself indicates that the deceased was riding his vehicle in a negligent manner, without noticing the speed breaker and consequently fell from from the bike and died. Therefore, this Court is of the view that absolutely, there is no negligence on the part of the accused to attract or constitute any offence as stated in the First Information Report. Therefore, continuing the investigation against the petitioner is nothing but a clear abuse of the process of law..

In view of the above, this Court is inclined to quash the First Information Report by exercising its jurisdiction under Section 482 of Cr.P.C.(corresponding to section 528 BNSS).

Accordingly, this Criminal Original Petition stands allowed. The First Information Report in Crime No.428 of 2024, pending on the file of the first respondent, is hereby quashed as against the petitioner. Consequently, the connected miscellaneous petition is closed. 16.09.2025 ham To
