Prayer: Original Petition filed under Sections 232 & 276 of the Indian Succession Act read with Order XXV Rule 5 of the Original Side Rules praying to grant of Letters of Administration with Will annexed of the properties and credits of deceased to the petitioner as wife, the beneficiary under the Will of the said deceased to have effect limited to state of Tamil Nadu.

This petition has been filed for grant of probate to the will of Mr.M.Rajagopal dated 03.08.1994.

R.SUBRAMANIAN.J., ay 2.The said Mr.M.Rajagopal died on 17.02.1996. The Legal Heir ship certificate has been marked as Ex.P.3. The other legal heirs who have been shown as respondents, have filed consent affidavits expressing their consent for grant of Letters of Administration. One Mr.D.Mani, attesting witness, has been examined as PW1. He has spoken about the execution of the Will by Mr.M.Rajagopal and its attestation by himself and by one Mr.Pakrudeen.

3.Taking into account the said evidence and the fact that the other legal heirs have filed consent affidavits, this application is allowed by granting Letters of Administration with the copy of the Will annexed to the petitioner.
