This writ petition has been filed to direct the first respondent to consider the representation dated 11.06.2025 submitted by the petitioner to rectify the revenue records in respect of the property comprised in Town Survey No.24, Survey No.24 and 3/2 an extent of 1377 sq.ft., situated at Door No.26, Block No.8, Ward B, First Street, Netukuppam, Kathivakkam, Thiruvottiyur, Chennai.
2. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the first respondent.
3. Even according to the petitioner, the subject property is in continuous possession and enjoyment of entire family members. Thereafter, the patta was issued in favour of the petitioner in the year 2014. In fact, on the basis of the patta, the petitioner also borrowed the subject property and availed loan from M/s. Equitas Finance Limited. When the petitioner verified the records, it was transferred in the name of the second respondent who is none other than the mother of the petitioner. On the strength of the patta, the second respondent executed a settlement in favour of the third 2/4
respondent herein dated 26.05.2025, vide Document No.4664 of 2025. Therefore, now the petitioner submitted a representation to rectify the mistake in the revenue records.
4. Admittedly, the petitioner's mother was issued patta and on the strength of the same, she executed the settlement deed in favour of the third respondent. Therefore, mere rectification of the revenue records would not serve any purpose since the subject property now settled in favour of the third respondent. Hence, the petitioner ought to have approached the Civil Court for appropriate relief. Therefore, the representation submitted by the petitioner cannot be considered and this Writ Petition is liable to be dismissed.
