O R D E R

The present Writ Petition (Criminal) has been filed seeking a direction to respondents 1 and 2 to transfer the petitioner's complaint dated 24.02.2025 to the file of the CBCID, by considering her representation dated 02.04.2025 and also to direct CBCID to conduct re-investigation and to file a final report within a time frame.

Mr.K.M.D.Muhilan, learned Additional Public Prosecutor, takes notice on behalf of respondents 1 & 2.

In view of the consent expressed by the learned counsel on either side, this Writ Petition (Criminal) is taken up for final disposal at the admission stage itself. Notice to the third respondent is dispensed with inasmuch as no order prejudicial to his interest is passed. 4.

Learned counsel appearing for the petitioner submitted that the petitioner lodged a complaint on 24.02.2025 before respondents 1 and 2 against the private respondent for fabrication of documents and illegally taking possession of the Slum Clearance Board tenement. Since there was no action taken pursuant to the petitioner's complaint, she once again sent a representation dated 02.04.2025, seeking transfer of the investigation pending on the file of the second respondent to CBCID. As no action has 2/5

been taken on the said representation as well, the present petition has been filed.

Learned Additional Public Prosecutor, appearing for respondents 1 & 2, submitted that the petitioner's complaint dated 24.02.2025 was enquired into by the Assistant Commissioner of Police, CCB-III, in C.No.244/2025 and upon finding that the dispute between the parties is civil in nature, the complaint was closed on 19.04.2025. In such view of the matter, the petition seeking transfer of investigation cannot be entertained. He fairly submitted that the closure report is yet to be served on the petitioner.

Recording the submission made by the learned Additional Public Prosecutor, this Writ Petition (Criminal) stands disposed of with a direction to the Assistant Commissioner of Police, CCB-III, to serve the closure report on the petitioner. The petitioner is at liberty to challenge the closure report, in the manner known to law, if so advised. No costs. 02.02.2026 ham 3/5
