Prayer:- Writ Petition filed under Article 226 of the Constitution of India, 1950, praying to issue a Writ of Mandamus, forbearing the Respondents from appointing candidates who have not secured 60% in the main subject part for which 60 marks awarded out of total of 150 marks in the Tamil Nadu Teacher Eligibility Test Paper-I and II conducted in pursuance to the notification of the First Respondent dated 24.02.2017 as a candidate who had not secured even 60% in the main subject would defeat the very purpose of the providing quality education to the students as envisaged under the Right to Education Act.

O R D E R

The Writ Petition has been filed for forbearing the Respondents from appointing the candidates who have not secured 60% in the main subject part for which 60 marks awarded out of total of 150 marks in the Tamil Nadu Teacher Eligibility Test Paper I and Paper II conducted in pursuance to the notification dated 24.02.2017 issued by the First Respondent as the candidate who had not secured even 60% marks in the main subject would defeat the very purpose of the providing quality education to the students as envisaged under the Right of Children to Free and Compulsory Education Act, 2009.

When it was pointed out that adequate particulars have not been produced for the relief claimed, Learned Counsel for the Petitioner seeks permission of this Court to withdraw the Writ Petition with liberty to file fresh Writ Petition with specific details and he has made an endorsement to that effect in the court record.

In fine, the Writ Petition is dismissed as withdrawn granting such liberty. Consequently, the connected Miscellaneous Petition is closed. No costs.
