This petition is filed to condone the delay of 163 days in filing the above second appeal against the decree and Judgment passed in A.S.No.10 of 2018 dated 28.04.2021 passed by confirming the judgment and decree dated 21.12.2016 passed in O.S.No.500 of 2009.

2. Heard both sides and perused the materials available on record.

3. Being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 163 days in filing the above second appeal is condoned and the petition is ordered.

4. Registry is directed to number the second appeal and list the case on 02.02.2023.
