ORDER

The relief sought for in this writ petition is to direct the respondents 2 & 3 to measure the petitioner's property in S.Nos.193/1, 193/4 respectively to an total extent of land 14 3/4 cents in Puthur Village, Thalaivasal Taluk, Salem District by disposing of the petitioner's online application dated 30.11.2023 vide Challan No.20231130011814.

2. Mr.C.Jayaprakash, learned Government Advocate takes notice on behalf of respondents 1 to3. Mr.L.Baskaran, learned Government Advocate takes notice on behalf of fourth respondent. By consent of both the parties, this writ petition is taken up for final hearing at the 2/6

admission stage itself.

The case of the petitioner is that the petitioner is the absolute owner of the property comprised in S.Nos.193/1, 193/4, respectively, to an extent of 14 3/4 cents in Puthur Village, Thalaivasal Taluk, Salem District. This being so, the petitioner filed an application through online dated 30.11.2023 for the purpose of conducting survey and measurement of the property along with requisite fee. However, till date, no order was passed by the respondents. Hence, the petitioner has come forward with the present writ petition.

Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that, it would suffice, if this Court issues direction to the respondents 2 & 3 to consider the petitioner's online application dated 30.11.2023 to survey and measure the petitioner's property and fix the boundaries.

5. Learned Government Advocate appearing for the respondents 1 to 3 submitted that the petitioner's online application dated 30.11.2023 would be considered and orders passed within a time frame that may be 3/6

fixed by this Court.

6. Heard the learned counsel on either side and perused the materials available on record.

Considering the limited relief sought for by the learned counsel for the petitioner, this Court directs the respondents 2 & 3 to measure and fix the boundaries in respect of aforesaid petitioner's property, after giving due notice and opportunity of personal hearing to the petitioner as well as aggrieved persons, if any, within a period of two weeks from the date of receipt of a copy of this order. It is needless to say, in case of any obstruction being created by third parties, the third respondent is at liberty to approach the Police officials/fourth respondent, in which case, the Police officials/fourth respondent shall render assistance to the third respondent to carry out the aforesaid exercise.

8. With the aforesaid direction, this writ petition is disposed of. No costs.
