The writ petition is filed for the relief herein below set out: 1/4

directing the respondents to pay 10% interest towards belated payment of terminal benefits such as Provident Fund, Gratuity, Leave salary and commutation to the petitioner.

2. The brief facts which has culminated in the filing of this writ petition are set out below:

2.1. It is the case of the petitioner that he joined the service of the respondent Corporation as Junior Engineer on 09.04.1983. After serving for a continuous period of 39 years, the petitioner had opted for voluntary retirement from service on 30.06.2021. At the time of such retirement, the respondent had not settled his terminal benefits such as Gratuity, Provident Fund and earned leave salary to the petitioner. The same was settled with a delay. Hence, the petitioner claims that he is entitled to get 10% interest to the belated payments.

3. The petitioners had made a representation dated 28.07.2025 to the respondent claiming interest for the belated payment of Gratuity, Provident Fund and leave salary, however, the same had not been considered by the 2/4

respondent.

4. Heard the learned counsels on either side and perused the records. 5.

Considering the facts and circumstances of the case, it is evidently clear that the petitioner is entitled to interest on the belated payment of amounts. A mandamus is therefore issued, directing the respondent to pay 6% interest per annum, instead of 10% per annum as claimed for towards belated payment of terminal benefits such as Provident Fund, Gratuity and Leave salary within a period of one month from the date of receipt of a copy of this Order.

6. Accordingly, the Writ Petition is Allowed. There shall be no order as to costs.
