Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records relating to the recovery order in proceedings Se.Mu.Aa.No.S1/004035/2023 dated 22.05.2024 of the 2nd respondent and quash the same in the light of the orders passed in W.P.Nos.20331, 20343, 20346, 20348, 20349, 20029, 20033, 20037 and 20042 of 2024, with a further direction to refund the amount already recovered.

ORDER

This Writ petition has been filed seeking quashment of the recovery proceedings issued by the 2nd respondent in Se.Mu.Aa.No.S1/004035/2023 dated 22.05.2024 in the light of the orders passed in W.P.Nos.20331, 20343, 20346, 20348, 20349, 20029, 20033, 20037 and 20042 of 2024 and for a consequential direction for refund of the amount already recovered.

2. When the matter is taken up for hearing, the learned Additional Government Pleader appearing on behalf of the respondents fairly submitted that the impugned order has been passed without conducting any enquiry and further submitted that the 2nd respondent would withdraw the same, without prejudice to the disciplinary proceedings initiated against the petitioner. Learned counsel further submitted that, a fresh charge memo has already been issued.

Recording the above submissions made by the learned Additional Government Pleader, the impugned order issued by the 2nd respondent dated 22.05.2024 is quashed and the matter is remitted to the 2nd respondent for fresh consideration, who in turn, shall pass appropriate orders on merits and in accordance with law, after issuing fresh notice and after affording an opportunity of hearing to the petitioner.
