Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to Substitute the Petitioners / Legal Heirs 1 to 4 herein as the Petitioners in WP No. 19552 of 2012 on the file of this Honble Court in the place of the deceased Petitioner (Mr.A.M.Venkatakrishnan)(in WMP.No.29823/2019) Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.L.POOVENDRA PERUMAL for SAI AND BHARATH, Advocate for the petitioner and of M/S.C.MUNUSAMY, Standing Counsel on behalf of the 1 & 2 respondents the court made the following order:- Mr.A.M.Venkatakrishnan, the writ petitioner herein suffered an order of dismissal dated 4.2.2011. Questioning the same, he filed the writ petition on 23.7.2012 after a period of 11⁄2 years. When the matter was pending, the writ petitioner died on 6.5.2015. Without moving appropriate application to continue the https://hcservices.ecourts.gov.in/hcservices/
challenge against the order of dismissal dated 4.2.2011, the proposed petitioners, sleeping over this matter for over five long years, have come to this Court, mindless of the consequence of abatement and the expiry of the limitation period, seeking to substitute them in the place of the deceased writ petitioner. Therefore, this Court is not inclined to entertain the miscellaneous petition seeking to bring them on record. Accordingly, the writ miscellaneous petition stands dismissed. Post the writ petition along with W.P.No.19553 of 2012 after three weeks. In the meantime, the respondents shall file the counter affidavits.
