The relief sought for in this Writ Petition is to direct the first respondent to take disciplinary action against the second respondent, based on the petitioner's complaint dated 01.03.2016.
2.The writ petitioner states that his marriage with one Tmt.Radha was solemnized on 25.03.2012. Due to some family quarrels within the members of the family, the writ petitioner filed H.M.O.P.No.500 of 2015, seeking divorce and the wife of the writ petitioner filed H.M.O.P.No.70 of 2015, for restitution of conjugal rights. The wife of the writ petitioner has also preferred a complaint before the Police and the second https://hcservices.ecourts.gov.in/hcservices/
respondent-Inspector of Police, called the writ petitioner for enquiry and the allegations set out by the writ petitioner is that the second respondent compelled the writ petitioner to bring a sum of Rupees one crore towards settlement to his wife. 3.In this regard, the writ petitioner made a complaint against the second respondent, in personal capacity and the Central Crime Branch, Coimbatore City Police conducted a detailed enquiry in relation to the complaint preferred by the writ petitioner. The learned Government Advocate appearing for the first respondent submitted the copy of the enquiry report submitted by the District Crime Branch dated 26.3.2016.
On completion of the detailed enquriy, the authority who conducted the enquiry came to the conclusion that the allegations set out in the complaint preferred by the writ petitioner were false and in view of some personal vengeance and family disputes, such a false complaint has been made against the second respondent. 4.In view of the report submitted by the first respondent, this Court is not inclined consider the merits of the matter and accordingly, the Writ Petition stands dismissed No costs.
