The petition has been filed seeking bail in connection with Crime No.173 of 2025 for the alleged offences punishable under Section 9 of Prohibition of Child Marriage Act and 5(1), 5(j)(ii) and 6(1) of POCSO Act, 2012.
2. The petitioner herein was arrested on 01.08.2025 for the offences under Sections 9 of Prohibition of Child Marriage Act and 5(1), 5(j)(ii) and 6(1) of POCSO Act. A 13 years old minor girl being subjected to penetrative sexual assault and she is also got conceived due to the said Act. Her statement under section 164 of Cr.P.C., indicates that the petitioner is the cause for the pregnancy. After the matter came to light of the Law Enforcing Agency, the foetus has been aborted and sent for DNA test.
3. The learned Government Advocate (Crl.Side) appearing for the respondent police opposed for grant of bail on the ground that if the petitioner is released on bail, he may threaten the defacto complainant. 2/4
4. In view of the above fact, till the receipt of DNA report, the petitioner cannot be released on bail.
