ORDER

This writ petition has been filed to direct the respondents to register the petitioner Partition deed dated 10.07.2025 based on online Token Temporally No TP/225955218/2025 and Reservation Serial No:1 (D-301) dated 28.07.2025 on the file of the third respondent.

2. Mr.P.Harish, learned Government Advocate takes notice on behalf of the respondents. By consent of both the parties, this writ petition is taken up for final hearing at the admission stage itself.

3. The case of the petitioner is that the petitioner's mother is the absolute owner of the property comprised in Old Survey No:234-2, ReSurvey No:220/1 Punjai-Hec-0.28.50 Punjai Acre: 0.34 1/2 cent Patta No:276, situated at Lakkampatti Village, Gopichettypalayam Taluk, 2/6

Erode District. In regard to the said property, the petitioner's mother executed a will in favour of petitioner and his brother and died on 21.08.2005. Thereafter, the petitioner and his brother took possession and enjoyed the property. Unfortunately, the petitioner's brother also died on 23.01.2023. In such circumstances, the petitioner and his brother's wife and daughter decided to execute partition deed, in respect of the aforesaid property and entered partition deed dated 10.07.2025. In order to register the said partition deed before the third respondent, the petitioner made online registration in the registration portal and also received the online token No:TP/225955218/2018 dated 28.07.2025 along with Serial No:1 (D301). When the petitioner approached the third respondent in person, along with necessary documents to register the aforesaid partition deed, the third respondent returned the partition deed without any refusal order. Hence, the petitioner has come forward with the present writ petition.

4. Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that it would suffice, if this Court issues direction to the third respondent to register the partitioner's 3/6

partition deed dated 10.07.2025 based on online Token Temporarily No TP/225955218/2025 and Reservation Serial No:1 (D-301) dated 28.07.2025.

5. Learned Government Advocate appearing for the respondents submitted that the petitioner has not applied/registered in the online portal. In the event of any application is received from the petitioner, the same would be considered and orders passed within a time frame that may be fixed by this Court.

6. Heard the learned counsel on either side and perused the materials available on record.

Considering the submissions made by the learned counsel on either side, this Court is inclined to issue the following directions: (i) The third respondent is directed to register the petitioner's partition deed, after verifying the online portal, since the petitioner was issued with an Online Token dated 28.07.2025. (ii) In the event of non-availability of application in the 4/6

online portal, the third respondent is directed to accept the physical copy of the documents and register the same, as expeditiously as possible. With the aforesaid directions, this writ petition is disposed of. No costs.
