These three applications are to bring on record the legal representatives of the deceased sole appellant, to set aside the abatement caused due to the death of the sole appellant and to condone the delay of 1293 days in filing the petition to set aside the abatement caused due to the death of the sole appellant. The endorsement on the bundle shows that copies have been served on the learned counsel appearing for the respondents. The matter is taken up today and there is no appearance for the respondents.

2.I have gone through the affidavit, the reason for delay, being the petitioner was under deep mental distress on account of death of his wife. The reason is convincing.
