By way of filing this writ petition, the petitioner seeks a direction to the respondents to return all the original certificates produced by her before 11.03.2016 so as to enable her to attend the interview conducted by the UPSC on 14.03.2016.

The petitioner, who was appointed as Assistant Surgeon (Speciality) in the second respondent College, has received a call letter from the UPSC for appointment to the post of Divisional Medical Officer (Pathology) in the Indian Railways and she was directed to appear for the interview scheduled on 14.03.2016 at Delhi. Therefore, she has made representations to the respondents on 21.02.2016 and 02.03.2016 requesting them to return all the original certificates for interview, with a further undertaking that she would return all the original certificates after the interview is over. On non-consideration of her representations, she has filed the present writ petition with a prayer cited supra.

On instruction, learned Government Advocate appearing for the respondents submitted that she has joined the duty in the second respondent College with a condition that she should join duty by depositing all the original certificates. According to the said condition, she has also submitted all her original certificates. He further submitted that all her original certificates would be returned after the regularization of her services. Since the petitioner went on leave due to her pregnancy, the respondents have not disposed of her representations.
4. At the outset, it is seen that the petitioner, while making the representations as stated above, has given an undertaking that she would return all the original certificates, after the interview is over, which is scheduled to be held on 14.03.2016.
Therefore, there is no impediment for the respondents to return all the original certificates received from the petitioner. Accordingly, on this score, the second respondent is directed to return all the original certificates received from the petitioner forthwith. It is made clear that after the interview is over, she should re-submit those original certificates. With this direction, the writ petition stands allowed. No Costs. WMP.No.7620 of 2016 is closed.
