By an order dated 17.09.2019, the second appeal was dismissed for non prosecution. This Civil Miscellaneous Petition No.2383 of 2020 is filed to restore the second appeal.

2. This Court, by an order dated 21.04.2023 issued notice to the respondents. The respondents 1 to 3 were served. Notice sent to the respondents 4 and 5 returned as 'dead'. Notice sent to the respondents 6 and 7 returned as 'left'.

3. This matter was listed on 29.01.2024. At the request of the learned counsel for the appellants the matter has been adjourned to 05.01.2024, 29.01.2024 and 15.02.2024 to take steps to substitute the legal heirs of the deceased respondents 4 and 5. Even today, when the matter is listed for hearing, no steps have been taken to substitute the legal heirs. Further, there is no representation on the side of the appellants.
