PRAYER: Original Petition filed under Section 372 of Indian Succession Act, 1925 read with Order XXV Rule 6 of O.S.Rules, prays that necessary succession certificate may be granted in favour of the petitioner with the power to collect the debt and to receive interest, morefully described in the Schedule hereunder, in accordance with law.

ORDER

The petitioner seeks Succession Certificate in respect of the securities held by Late Mrs.Sankari Sivarajan, who died intestate on 19.05.2024. The petitioner is the only daughter of the deceased. The husband of the deceased predeceased her on 05.11.2005.

2. The petitioner has examined herself as PW1. She has produced the computer generated Death Certificate of the deceased and her husband as Ex.P2 and Ex.P1. The legal heirship certificate of the deceased as Ex.P3. On perusal of Ex.P3, shows that the petitioner is the only daughter of the deceased and surviving legal heir of the deceased. 3.The assertions in the petition have been duly proved by adducing oral evidence supported by documents. In these circumstances, the petitioner is entitled to the relief.

4. In view of the above evidence, the Original Petition is allowed granting Succession Certificate in favour of the petitioner, with the power to collect the securities and receive the interest and dividends mentioned in the schedule to the petition.
