Ms.A.Suganya, Government Advocate Judgment (Judgment of the Court was delivered by S.M.Subramaniam J.) The disputed facts relating to the marital status cannot be adjudicated in the writ proceedings under Article 226 of the Constitution of India. Such civil rights are to be determined by approaching the competent Civil Court of law.
2. In the present case, the appellant who was the writ petitioner claims that she is the first wife of the deceased employee and the official respondents have erroneously sanctioned family pension to the 6th respondent, who is the second wife of the deceased employee.
3. When the marital status between the appellant as well as the 6th respondent is disputed, the issues are to be resoled by approaching the competent Civil Court of law. Only after securing declaration regarding the marital status, the appellant would be in a position to establish her claim in the
manner known to law.
4. In view of the fact that the appellant has not approached the Civil Court for securing appropriate declaration, the Writ Court has dismissed the Writ Petition, which cannot be held as perverse. Thus, the Writ Appeal stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
