This Miscellaneous Petition has been filed to modify the condition imposed by this Court in Crl.O.P.No.20482 of 2024 vide order dated 12.09.2024 that the petitioner shall stay at Namakkal District and sign before the Town Police Station, Namakkal, daily at 10.30 a.m. for a period of two months and thereafter shall appear before the respondent police on every Tuesday and Sunday for another period of three months.

2. The learned counsel for the petitioner would submit that this Court while granting bail to the petitioner, had directed the petitioner to stay at Namakkal District and sign before the Town Police Station, Namakkal, daily at 10.30 a.m. for a period of two months. After coming out from prison, the petitioner reported before the Town Police Station, Namakkal on 16.09.2024. Since the petitioner is a daily Cooli worker, he has no income and thereby, he could not stay at Namakkal and comply with the said condition regularly. Hence, the present petition is filed to modify the said condition.

3. The learned Government Advocate (Crl. Side) raised objections stating that the petitioner complied with the said condition only for one day i.e. on 16.09.2024 and it is a case of 302 IPC. Page No.1/3

4.Considering the submissions of the learned Government Advocate (Crl. Side) and the nature of offence, the said condition is modified to the effect that "the petitioner shall report before the Town Police Station, Vellore, daily at 10.30 a.m. for a period of two months and thereafter shall appear before the respondent police on every Tuesday and Sunday at 10.30 a.m. for another period of three months".
